Historically, academic journals have served a different purpose than the Academy itself. Journals have served as privileged sites for the articulation and concretization of specific modes of knowledge and control.

This essay discusses the most recent manifestations of the debate of the law and literature movement. The essay traces the evolution of the Law and Literature schools and identifies some of their adherents and conclusions, shows how these schools have influenced the conceptual development and teaching of American law, presents connections between the Critical Legal Studies and Law and Economics movements in the U.S., and raises questions about the Law and Literature movement.

This thesis examines some mind-body problems traditionally ascribed to Descartes' philosophy. One such problem focuses on inconsistencies in Descartes' general causal claims. Another problem, first put forward by Simon Foucher, concerns Descartes' purported espousal of the following inconsistent triad: mind-body causal interaction, mind-body distinctness, and "the causal likeness principle." The final problem is one regarding free will and determinism. ;In the first Chapter I examine the content and number of Descartes' causal principles. An analysis of the main concepts used in (...) these principles, for example, "perfection," "eminent containment," and "formal containment," is provided. This examination includes a discussion of some medieval antecedents of these concepts. I argue that there is no blatant inconsistency generated by Descartes' causal claims. ;In the second chapter I utilize the analysis of "eminent containment" to show that Descartes was not committed to a "causal likeness principle." Since this principle is crucial for generating the "Foucher mind-body problem," I thus demonstrate that this problem is not one that applies to Descartes' philosophy. ;In this chapter I also examine Descartes' views about the details of psycho-physical change. While there is no blatant inconsistency among these views, I show that Descartes is committed to the inexplicability and indeterminism of the acts of the will. This presents a problem given Descartes' acceptance of psycho-physical interaction and of Laplace-like determinism. ;In the final chapter I argue that Descartes could have avoided this problem by denying Laplacean determinism, but since he lacks a clear position on the matter, it is not the move he himself makes. I also show how Descartes vacillates between a compatibilist and an incompatibilist view of free will. (shrink)

Martin Heidegger is, perhaps, the most controversial philosopher of the twentieth-century. Little has been written on him or about his work and its significance for educational thought. This unique collection by a group of international scholars reexamines Heidegger's work and its legacy for educational thought.

Everyday there are revelations of organizations behaving in discreditable ways. Sometimes these actions result in damage to an organization's reputation, but often they do not. In this article, we examine the question of why external stakeholders may overlook disclosed discreditable actions, even those entailing ethical breaches. Drawing on stigmatization theory, we develop a model to explain the likelihood of reputational loss following revelations of discreditable actions. The model integrates four properties of actions (perceived control, perceived certainty, perceived threat, and perceived (...) deviance), stakeholder motivation, and media coverage. Implications for theory and for practitioners concerned with reputation management are discussed. (shrink)

Hogan argues that the basis of interpretive method is ordinary inferential reasoning - that there is no general methodological difference between interpretation in the humanities and theory construction in the physical sciences. Further, the nature of interpretation does not entail cultural, historical, or other forms of relativism, as is commonly thought. However, this does not imply that there is only one way of approaching interpretation or that there is one true meaning of any particular work. Rather, there are many (...) kinds of interpretation and many kinds of meaning and the interpreter is free to stipulate one of these in the context of a particular enquiry. More exactly, discussing the constraints upon stipulation, Hogan says that, although there are a large number and variety of intents (those of authors and readers, conscious and unconscious), there are no nonintentional meanings - Platonic, social, essential, or otherwise. We examine the problem of deducing the geodesic motion of test particles from Einstein's vacuum field equations and its extension to include gravitational radiation reaction. In the latter case we obtain an equation of motion for a particle which incorporates radiation reaction of the electrodynamical type, but due to shearing radiation, together with a mass-loss formula of the Bondi-Sachs type.

T.M. Robinson, in Plato's Psychology, concludes that an examination of the Charmides shows that soul is (1) a cognitive principle, (2) a moral principle, (3) to be equated, together with the body, with the self or person, (4) related to the body by "mutual entailment." I argue that (4) is not implied by the text and that Robinson's interpretation rests upon illegitimately pressing an analogy presented therein, and that even if the analogy could be pressed, that Robinson's view (which seems (...) to embody a confusion over the nature of 'entailment') would still not be defensible, I argue further that (3) depends upon an unjustifiable equation of 'self' with 'whole man.' I accept (and present additional evidence for) (1) and (2) as true of soul in the sense I take to be implied by the text. But the evidence for (1) and (2) further damages Robinson's claims (3) and (4). (shrink)

We derive, from the Einstein-Maxwell field equations, the Lorentz equations of motion with radiation reaction for a charged mass particle moving in a background gravitational and electromagnetic field by utilizing a line element for the background space-time in a coordinate system specially adapted to the world line of the particle. The particle is introduced via perturbations of the background space-time (and electromagnetic field) which are singular only on the source world line.

This paper discusses the interpretation of Charmides 164Dff. given by John Gould in The Development of Plato's Ethics. Gould claims that in this passage Plato wishes to indicate that he wants to delimit or qualify Socrates' analogy between morality or virtue on the one hand and art or craft (technē) on the other. Plato does this, supposedly, by showing us the unacceptable consequences which follow from assuming a complete analogy between morality and technē. I argue that this interpretation conflicts with (...) the text, which seems to indicate that the root of whatever problems occur in the dialectic is not the technē analogy, but rather that the analogy is not being applied strictly enough. In particular, I try to show that the failure of Critias' definition of temperance is due, in large measure, to his failure to specify an object for the knowledge which he asserts is equivalent to temperance.
